〜テネシー州にお住まいの皆様へ〜
１０月１日より、テネシー州の外国人向け運転免許制度が改正され、従来の運転証明証（Certificate for driving：CFD)制度が廃止され、新たにＩＤとして利用できる暫定運転免許証（Temporary driver license: TDL)が発行されることになりました。

当館よりテネシー州保安局（Department of Safety）に対し、TDL制度（特にテネシー州に住む在留邦人との関係）につき問い合わせましたところ、当局から回答（英文）があり先日皆様に送付したところです。今般、当館においてその仮訳を作成しましたのでご参考までに送付いたします。

なお、当局によりますと、一定の場合において日本の有効な運転免許証を携帯することによりテネシー州内で自動車を運転することができる趣ですが、この場合は、有効な国際運転免許証も併せ携帯することをお勧めします。

（仮訳）



１. D種免許証（Class D License）または運転証明証（CFD: Certificate for Driving）を所持するテネシー州在留邦人についての取り扱い



１）失効した、あるいは失効時期が近い運転証明証（CFD）を所持しているテネシー州に居住する日本国民

　暫定運転免許証（TDL: Temporary Driver License）または暫定身分証明書（TID: Temporary ID）を申請するためには、申請者は、日本国旅券、査証、I-94または365日以上の滞在許可期間が記載された米国移民局（USCIS）の書類のいずれか、及びテネシー州居住の証拠書類２種類を、53箇所ある運転免許センター(driver license service center)のいずれかの職員（examiner）に提示する必要がある。特定の査証の分類に応じた追加的な資格を以下に列記する。



a. 有効な旅券と査証及びI-94を所持する一時的就労者（例：H1B、H1C、H2A、H2B、H3、H4、J1、O1、O2、P1、P2、P3、R1、TN）は、国土安全保障省240日規定（DHS 240-day rule）に基づきTDLを申請する資格を有する。現在のI-94の失効時期が１年未満の間にある場合は、申請時に125日以上の残余滞在許可期間があれば、Notice of Action form (I-797)を提出することができる。このNotice of Action form (I-797)は、滞在の延長（I-129、I-539）または滞在資格の変更（I-485）の申請が米国移民局に係属中であることまたは米国移民局によって承認されていることを示すものでなければならない。

b. 学生（F1又はM1）は、就学及び実習（optional practical training）または右の就学もしくは実習のいずれかの期間の開始日と終了日を示すSEVIS I-20書類を提示しなければならない。

c. 交流を目的とする訪問者 (exchange visitor) または学生（J1）は、滞在許可期間の開始日と終了日を示すDS-2019書類を提示しなければならない。



２）D種免許証を所持しているテネシー州に居住する日本国民

当該の日本国民が2001年1月1日より前にD種免許証を取得している場合は、その免許証は有効である。D種免許証の最初の発行時以降、継続的にテネシー州に居住している日本国民の場合、免許証保持者は追加の書類を要せず、いずれかの運転免許センターまたは郡主事事務所（county clerk office）において、郵便またはインターネットによりD種免許証を更新することができる。

2001年1月1日以降にＤ種免許証を取得した場合は、免許証保持者は、D種免許証を保持するためには、州内に53箇所ある運転免許センターのいずれかにおいて、米国の市民権または永住権（U.S. Permanent Resident Alien）を証明する書類を提出する必要がある。申請者が米国市民権または永住権を証明する書類を提出することはできないが、365日以上の滞在許可期間を証明する書類を所持する場合は、申請者はTDLを申請する資格を有する。



３）有効な運転証明証（CFD）を所持しているテネシー州に居住する日本国民

有効なCFDを所持する外国人は、そのCFDが失効、停止、廃止、または取り消しとなるまで、CFDを携帯することによりテネシー州内を引き続き運転することができる。TDLの取得はCFD保持者の選択に委ねられる。TDLを申請する際は、1年以上の滞在許可期間を証明する米国移民局の書類、身分証明書２種類、テネシー州居住の証拠書類２種類、社会保障番号が発行されている場合はその社会保障番号の証拠書類を提示する必要があり、また、米国移民局の書類上の氏名と異なる氏名を使う場合は、氏名の変更を証明する書類も提示する必要がある。



２. テネシー州に来着する日本国民

１）テネシー州に来着する外国人で、米国移民局の書類に記載された滞在許可期間が１年未満の場合

滞在許可期間の要件を満たさない外国人は、現在のところ、他州、他国または国際機関により発行された有効な運転免許証を所持しており、その運転免許証がテネシー州で必要とされる種類の運転免許証に相当する場合（例えば、商用車を運転する場合には、自国の運転免許証も商用車を運転できる免許証でなければならない等）には、その運転免許証を携帯することによりテネシー州内で自動車を運転することができる。



２）テネシー州に来着する外国人で、米国移民局の書類に記載された滞在許可期間が１年以上の場合

１年以上の滞在許可期間を証明する書類を所持する外国人は、50箇所の全業務を取り扱う運転免許センター（full service driver testing center）のいずれかでTDLを申請することができる。申請者は、身分証明書２種類、テネシー州居住の証拠書類２種類、社会保障番号が発行されている場合はその社会保障番号の証拠書類を提示する必要があり、また、米国移民局の書類上の氏名と異なる氏名を使う場合は、氏名の変更を証明する書類も提示する必要がある。他州が発行した有効な免許証を所持していない申請者は、学科、運転技能、視力の試験を受ける必要がある。



３. 暫定運転免許証（TDL）の試験要件

１）有効な運転証明証（CFD）またはD種免許証を所持しTDLを申請する日本国民

有効なCFDまたはD種免許証の保持者は、下記の場合を除いてTDLを取得するために追加試験を受けなくてもよい。

a) 自動二輪免許を追加する場合

b) 商用免許（for hire endorsement)を追加する場合

c) 託児施設用バンの運転手（childcare van driver）であるという証明を追加する場合

d) 未成年者用仮免許証（learner permit）から条件付きのTDL（intermediate restricted　TDL）または成人用の仮免許証(adult leaner permit for TDL)に切り替える場合



２）失効した、運転証明証（CFD）、テネシー州D種免許証、州外の免許証を所持する日本国民

テネシー州のCFDまたはD種免許証で、失効してから５年を超えている場合は、TDLの申請者は学科、運転技能、視力の試験を受ける必要がある。他州発行の免許証で失効してから６ヶ月を超えている場合は、TDLの申請者は学科、運転技能、視力の試験を受ける必要がある。



４. 暫定運転免許証（TDL）、暫定身分証明書（TID）の更新

TDLとTIDは外国人の米国における滞在許可や滞在資格に基づいて発行されるため、通常の運転免許証及び身分証明書は有効期間満了日の12ヶ月前から更新できるという規定の対象とはならない。全てのTDLは運転免許センターに本人が出向いて更新しなければならない。申請者は、テネシー州居住を証明する書類２種類及び１年以上の滞在許可期間を証明する米国移民局の書類を提示する必要がある。

I. Japanese citizens in Tennessee with a Class D license or CFD



1) Japanese citizen residing in TN and holding expired or expiring CFD

- In order to apply for the Temporary Driver License (TDL) or Temporary ID (TID) the applicant will need to present a Japanese passport, visa, I-94 or other USCIS documentation (along with the passport and visa) indicating an authorized stay of 365 days or more and two proofs of Tennessee residency to an examiner at one of the 53 driver license service centers. Listed below are additional eligibility guidelines for certain visa classifications:



a. Temporary Workers (e.g. H1B, H1C, H2A, H2B, H3, H4, J1, O1, O2, P1, P2, P3, R1, TN) with a valid foreign passport, visa and I-94 document may be able to qualify for a TDL under the DHS 240-day rule. If the current I-94 expiration date is less than one (1) year, then the applicant may provide a Notice of Action form (I-797) if he or she has at least 125 days of authorized stay remaining at the time of application. This Notice of Action (I-797) must indicate an application for extension of stay (I-129, I-539) or adjustment of status (I-485) is pending or approved by USCIS.


b. Students (F1 or M1) should present a SEVIS I-20 document that indicates the beginning and end dates for the period of study and/or optional practical training.

c. Exchange Visitors or Students (J1) should present a DS-2019 document that indicates the beginning and end dates of authorized stay.


2) Japanese nationals residing in Tennessee holding a Class D license – If the Japanese citizen received the original Class D license prior to January 1, 2001, the license is valid, and Japanese foreign national has continuously resided in Tennessee since the original issuance of the Class D license then the license holder should be able to renew the Class D license without additional documentation at one of the driver license stations, county clerk offices, by mail or via the internet.



If the Class D license was obtained after January 1, 2001 the license holder will need to provide documentation evidencing U.S. Citizenship or U.S. Permanent Resident Alien at one of the 53 driver license service centers statewide to retain the Class D license. If the applicant cannot provide U.S. Citizenship or Permanent Residency documents but has documents evidencing an authorized stay in the country of 365 days or more the applicant may be eligible to apply for a Temporary Driver License.



3) Japanese nationals residing in Tennessee holding a valid CFD – Foreign nationals holding a valid CFD may continue to drive in Tennessee with a CFD until it expires or is suspended, revoked, or canceled. Obtaining a Temporary Driver License is the CFD holder's choice. Applicants for TDL will be required to present USCIS documentation evidencing one year or more of authorized stay; two proofs of identity, two proof of Tennessee residency; proof of a social security number if one has been issued; and proof of any name changes if name differs from that on USCIS documentation.



II. Japanese nationals arriving in Tennessee



1) Foreign nationals arriving in Tennessee with less than a year of authorized stay indicated on USCIS documentation - Foreign nationals who do not meet the authorized stay requirements, at this time, may operate a motor vehicle in Tennessee with a license issued by another state, country, or international body provided the license is valid and the license is equivalent to the class license required in Tennessee ( e.g. to operate a commercial motor vehicle the home county license must grant license holder commercial vehicle operating privileges....).



2) Foreign nationals arriving in Tennessee with a year or more of authorized stay indicate on USCIS documentation - Foreign nationals who have documentation evidencing a year or more of authorized stay in the country may apply for a TDL at any one of the 50 full service driver testing centers. Such applicants must also present two proofs of identity, two proofs of Tennessee residency; proof of a social security number if one has been issued; and proof of any name changes if name differs from that on USCIS documentation. Applicants not holding a valid license from another state will be required to take the knowledge, road skills, and vision tests.



III. Testing Requirements for TDLs



1) Japanese citizens holding valid CFD or Class D applying for TDL – Valid CFD or Class D license holders will not have to take additional tests to obtain a TDL unless they are: a) adding a motorcycle license; b) adding a for hire endorsement; c) adding a childcare van driver certification; or d) exchanging a learner permit for either an intermediate restricted TDL or adult learner permit for TDL.



2) Japanese national holding an expired CFD, TN Class D, or out-of-state license - If it is a Tennessee CFD or Class D license and it has been expired over five(5) years then an applicant for a TDL will have to take the knowledge, road skills, and vision tests. If it is a license from another state and the license been expired over six months(s) then the applicant for a TDL will have to take the knowledge, road skills, and vision tests.



IV. Renewal of Temporary Licenses



1) Since Temporary driver licenses and identification licenses are issued based on a foreign national's authorized stay or status in the United States, they do not fall within the purview of the rule that permits unconditional driver license/IDs to be renewed up to twelve months before the expiration date. All TDLs must be renewed in person at a driver license service center. The applicant must present USCIS documentation evidencing a one year or greater authorized stay as well as two documents evidencing Tennessee residency.
